Available in PDF, EPUB and Kindle. Book excerpt: Leading the debate on the domestic effect of the growing influence of international adjudication, this invaluable text examines Serbia and Croatia’s erratic record of compliance with the International Criminal Tribunal for the Former Yugoslavia (ICTY). Since the demise of the Milosevic and Tudjman regimes, Serbian and Croatian governments have been inconsistent in cooperating with the ICTY, despite the conditions of EU membership and US financial incentives. This study reconstructs events before, during and after extradition to build up a picture of the complex politics involved in ICTY relations, and provides a conceptual framework to study compliance in international relations and law. Through this analysis, a historical tracing of varied factors of political influence and a conceptualization of compliance is provided, resulting in a rich interdisciplinary work embracing political science, international relations and social theory. By scrutinizing the social meanings and political practices which become attached to prescribed norms in compliance processes, this book provides a highly-relevant insight into contemporary meanings of ‘compliance’. Politics of International Law and Compliance will be of interest to students and scholars of politics, international relations and international law, and European politics.

Available in PDF, EPUB and Kindle. Book excerpt: The International Criminal Court remains a sensitive issue in American foreign policy circles. It was agreed to at the tail end of the Clinton administration, but with serious reservations. In 2002 the Bush administration ceremoniously reversed course and "unsigned" the Rome Statute that had established the Court. But recent developments in Washington and elsewhere indicate that the United States may be moving toward de facto acceptance of the Court and active cooperation in its mission. In Means to an End: U.S. Interest in the International Criminal Court, Lee Feinstein and Tod Lindberg reassess the relationship of the United States and the ICC, as well as American policy toward international justice more broadly. The authors argue that the United States should actively support the ICC for the simple reason that it serves U.S. interests while being consistent with the values that America publicly espouses. The authors also show how participation could be beneficial in terms of national security and foreign policy generally, and they make the moral case for acceptance as well. They evaluate the ICC's potential to advance international justice and how American participation can improve that potential.

Book excerpt: James examines at a broad level the concept of universalistic and "dignitarian" human rights, as expressed in such covenants as the International Bill of Rights, two United Nations documents published in 1966 that delineate civil, political, economic, social and cultural rights for all human beings. He gives an interdisciplinary account of the historical, legal, political, theoretical and philosophical development of ideas about human rights from the beginnings of our understanding of them up to 1939, describes the horrors of World War II and the resulting goal of the then-developing UN to create a universal declaration of human rights, and examines the often clashing concepts and motivations behind the creation of the 1966 covenants.

Available in PDF, EPUB and Kindle. Book excerpt: The basics of international criminal law, how it is actually enforced, and the arguments it has provoked are all introduced in a book that is as current as the headline news. International Crime and Punishment: A Guide to the Issues explores the many facets of this relatively new field of criminal law, an autonomous branch of law that concerns international crimes and the systems set up to handle individuals who are accused of committing them. As the author explains, international crimes include crimes against humanity, crimes against peace, war crimes, trafficking in human beings, drug trafficking, money laundering, arms trafficking, and smuggling of cultural artifacts. The laws may seem straightforward, but the system is not without controversy. As the author shows, the United States has opposed certain actions of the International Criminal Court, while other countries have objected to U.S. plans to refer persons accused of terrorism to military tribunals. Clearly and cogently, this work introduces the principles of international criminal law, its enforcement, and the conflicts that have arisen as a result. Journalists, policymakers, students, and educated citizens will find the book an essential tool for unraveling today's news stories.
