Despite addressing the Americas only marginally, social contract theories transformed American social imaginaries prevalent at the time into Aboriginality, allowing for the emergence of the idea of civilization and the possibility for diverse discourses of Aboriginalism leading to excluding and discriminatory forms of subjectivity, citizenship, and politics. What appears then is a form of Aboriginalism pitting the American/Aboriginal other against the nascent idea of civilization. The legacy of this political construction of difference is essential to contemporary politics in settler societies. The author shows the intellectual processes behind this assignation and its role in modern political theory, still bearing consequences today. The way one conceives of citizenship and sovereignty underlies some of the difficulties settler societies have in accommodating Indigenous claims for recognition and self-government.

It locates the central themes of that theory in the intellectual legacy of utilitarianism, particularly the problems of defining principles of justice and of showing the grounds of moral obligation. It demonstrates how theorists responded in a novel way to the dilemmas articulated in utilitarianism, developing in their different approaches a constructivist method in ethics, a method that aimed to vindicate a liberal, democratic and just political order. A distinctive feature of the book is its comparative approach. By placing the works of Barry, Buchanan and Tullock, Harsanyi, Gauthier, Grice, Rawls, and Scanlon alongside one another, similarities and differences are brought out, most notably in the way in which principles are derived by each author from the contractual construction as well as the extent to which the obligation to adopt those principles can be rationally grounded. Each theory is placed in its particular intellectual context. Special attention is paid to the contrasting theories of rationality adopted by the different authors, whether that be utility theory or a deliberative conception of rationality, with the intention of assessing how far the principles advanced can be justified by reference to the hypothetical choices of rational contracting agents. The book concludes with a discussion of some principal objections to the enterprise of contract theory, and offers its own programme for the future of that theory taking the form of the empirical method.

Recent work in political and social history, however, has shown that the state—at court, in the provinces, and in the parishes—depended on the authority of local magnates and the participation of what has been referred to as "the middling sort." This poses challenges to scholars seeking to describe how the state was understood by contemporaries of the period in light of the great classical and religious textual traditions of political thought. State and Commonwealth presents a new theory of state and society by expanding on the usual treatment of "commonwealth" in pre–Civil War English history. Drawing on works of theology, moral philosophy, and political theory—including Martin Bucer's De Regno Christi, Thomas Smith's De Republica Anglorum, John Case's Sphaera Civitatis, Francis Bacon's essays, and Thomas Hobbes's early works—Noah Dauber argues that the commonwealth ideal was less traditional than often thought. He shows how it incorporated new ideas about self-interest and new models of social order and stratification, and how the associated ideal of distributive justice pertained as much to the honors and offices of the state as to material wealth. Broad-ranging in scope, State and Commonwealth provides a more complete picture of the relationship between political and social theory in early modern England.
